These Terms & Conditions apply to purchases, custom orders, services, and other transactions with Hat Refinery, a DBA of Holcomb Creative Enterprises LLC, located in Austin, Texas ("Hat Refinery," "we," "us," or "our").
By placing an order, submitting artwork, approving a proof, making payment, or otherwise purchasing products or services from Hat Refinery, you ("Customer") acknowledge and agree to these Terms & Conditions.
Hat Refinery specializes in custom and personalized products, including but not limited to hats, patches, leatherette goods, laser-engraved products, UV-printed products, apparel, drinkware, signs, graphics, keychains, coasters, promotional products, and other custom merchandise.
Because many of our products are made specifically for each Customer, custom and personalized items generally cannot be resold or reused if an order is canceled, changed, or returned.
For this reason, all custom and personalized sales are final, except when Hat Refinery determines that a product contains a manufacturing defect or was produced incorrectly due to an error made by Hat Refinery.
When a digital proof, mockup, sample, or design is provided for approval, it is the Customer's responsibility to carefully review all details before approving production.
This includes, but is not limited to:
Once a Customer approves a proof, the proof is considered approved for production as shown.
Hat Refinery is not responsible for errors contained in an approved proof that were present when the Customer approved it.
Changes requested after approval may result in additional design, material, labor, setup, or production charges.
If production has already begun, requested changes may not be possible.
Customers acknowledge that colors displayed on phones, tablets, monitors, photographs, and digital proofs may differ from the appearance of the finished product.
Color differences may also occur between different production methods, including UV printing, DTF printing, laser engraving, embroidery or embroidered-style products, and other processes.
Leather, leatherette, wood, fabric, hats, garments, and other materials may contain natural or manufacturing variations in color, grain, texture, thickness, finish, stitching, or surface appearance.
Minor variations between individual pieces are normal and are not considered defects.
Placement of custom artwork may also vary slightly between individual products due to normal production tolerances.
Laser engraving permanently alters the surface of a material. The final color, darkness, contrast, texture, and appearance of an engraving can vary depending upon the material being engraved.
UV printing and other printing processes may also produce minor differences in color, texture, gloss, opacity, positioning, or finish.
Exact reproduction of colors shown on a digital screen cannot be guaranteed.
These normal production variations are not considered defects.
Hat Refinery may, at its discretion, agree to customize products supplied by a Customer.
Customer-supplied items are accepted at the Customer's risk.
Laser engraving, printing, heat application, pressing, adhesives, chemicals, or other customization processes can occasionally damage or react unexpectedly with certain materials.
Unless damage results from gross negligence or intentional misconduct by Hat Refinery, Hat Refinery is not responsible for replacing, reimbursing, or compensating the Customer for a customer-supplied item that is damaged during an otherwise reasonable attempt to perform the requested customization.
Customers are encouraged to provide additional items whenever possible.
By providing Hat Refinery with any logo, photograph, image, design, trademark, slogan, text, graphic, copyrighted material, or other content, the Customer represents that the Customer owns the material or has obtained all necessary permission, authorization, or licensing required for its use and reproduction.
The Customer authorizes Hat Refinery to reproduce, modify, resize, convert, print, engrave, or otherwise use the submitted material as reasonably necessary to complete the Customer's order.
The Customer is solely responsible for determining whether submitted material infringes upon any copyright, trademark, publicity right, privacy right, or other intellectual property or proprietary right belonging to another person or organization.
Hat Refinery reserves the right to refuse any artwork or order that we reasonably believe may violate applicable law or another party's rights.
To the extent permitted by law, the Customer agrees to indemnify and hold harmless Hat Refinery and Holcomb Creative Enterprises LLC from third-party claims, damages, losses, or reasonable expenses arising from materials supplied or specifically requested by the Customer.
Unless otherwise agreed to in writing, payment for a finished custom product does not automatically transfer ownership of Hat Refinery's original artwork, editable design files, production files, templates, layouts, vectors, source files, or other working files created during the design and production process.
The Customer receives the finished physical product ordered and any digital files specifically identified as part of the purchase.
Transfer or licensing of original design files may be available separately upon written agreement.
Unless otherwise agreed to in writing, payment is required before production begins.
Large, commercial, wholesale, or special orders may require a 50% or greater deposit with the remaining balance due before delivery or shipment.
Orders are not considered confirmed until required payment or deposit has been received.
Any applicable sales tax, shipping charges, delivery fees, special-order charges, artwork fees, setup charges, rush fees, or other approved charges may be added to the order.
Customers should contact Hat Refinery as quickly as possible if an order needs to be changed or canceled.
Orders may generally be changed or canceled without production charges only if production has not begun and materials have not been specially ordered.
Once artwork preparation, production, customization, or special material ordering has begun, some or all payments may become non-refundable.
If an order is canceled after costs have already been incurred, Hat Refinery may deduct design time, materials, setup costs, special-order merchandise, payment processing costs where legally permitted, and work already performed from any refund that may otherwise be available.
Custom products that have already been produced cannot be canceled or refunded.
Any quoted production or completion date is an estimate unless Hat Refinery expressly agrees in writing to a guaranteed deadline.
Production times may be affected by order volume, product availability, supplier delays, equipment issues, shipping delays, artwork approval, Customer response time, or circumstances outside our reasonable control.
Hat Refinery will make reasonable efforts to meet estimated completion dates but does not guarantee completion by a particular date unless specifically agreed to in writing.
Rush service, when available, may require an additional charge.
Shipping charges are calculated based on the order, destination, package size, weight, shipping method, and carrier.
Shipping and delivery dates are estimates unless the carrier specifically provides a guaranteed service.
Once an order has been transferred to a shipping carrier, delivery is primarily subject to the carrier's transportation network and policies.
Hat Refinery is not responsible for delays caused by the carrier, weather, natural disasters, transportation interruptions, incorrect or incomplete addresses supplied by the Customer, or other circumstances outside our reasonable control.
Customers are responsible for providing a complete and accurate shipping address when placing an order.
Additional shipping charges resulting from an incorrect or incomplete address provided by the Customer may be the Customer's responsibility.
If tracking information indicates that a package is delayed, missing, or lost, Customers should contact Hat Refinery so we can assist with the appropriate carrier claim or investigation when available.
A package being marked "delivered" by the carrier does not necessarily establish fault by either the Customer or Hat Refinery if the package cannot subsequently be located.
Hat Refinery will reasonably assist Customers with carrier claims when appropriate; however, replacement or reimbursement for packages lost or stolen after confirmed delivery may depend upon carrier coverage, shipping insurance, and the circumstances of the loss.
Hat Refinery is not responsible for theft occurring after a package has been delivered to the address supplied by the Customer.
Customers should inspect shipped merchandise promptly after delivery.
If an order arrives damaged, the Customer must notify Hat Refinery within 3 calendar days of delivery.
The Customer may be required to provide photographs of:
Customers should not discard damaged products or packaging until instructed to do so, as the shipping carrier may require them for inspection or a claim.
Hat Refinery will work with the Customer and carrier, when applicable, to determine the appropriate resolution.
Because custom products are made specifically for the Customer, customized, personalized, engraved, printed, decorated, or otherwise made-to-order products are final sale and are not eligible for return, exchange, or refund because of a change of mind, incorrect Customer selection, or an error contained in an approved proof.
If Hat Refinery makes an error in production or the product has a verified manufacturing defect, we will determine an appropriate remedy, which may include repair, replacement, reproduction, store credit, or refund.
Unused, non-custom merchandise may be eligible for return when approved by Hat Refinery.
Customers must contact Hat Refinery before returning merchandise.
Returned merchandise must generally be unused, unworn, unwashed, unaltered, and in its original condition and packaging.
Unless the return results from an error by Hat Refinery or a verified defective product, original shipping charges and return shipping costs are generally non-refundable.
Unauthorized returns may be refused.
Any claim involving an incorrect item, manufacturing defect, production error, missing item, or shipping damage should be reported to Hat Refinery within 3 calendar days after delivery or receipt of the order.
Customers should provide photographs and a description of the issue sufficient for Hat Refinery to evaluate the claim.
Hat Refinery may request that the product be returned before issuing a replacement or refund.
Nothing in this section limits rights that cannot legally be waived or restricted under applicable law.
When Hat Refinery determines that we made an error, we will make reasonable efforts to correct the problem.
Depending upon the circumstances, Hat Refinery may elect to:
The appropriate remedy will depend upon the nature of the problem and applicable law.
A remake or replacement does not entitle the Customer to keep both the original and replacement product if Hat Refinery requests return of the original item and provides reasonable return instructions.
Customers are responsible for following any care instructions provided with their products.
Damage caused by misuse, improper washing, excessive heat, chemicals, abrasion, improper storage, normal wear and tear, accidents, or failure to follow care instructions is not considered a manufacturing defect.
The durability of printed, engraved, applied, or decorated products may vary depending upon the product, material, frequency of use, environment, and method of care.
Unless a Customer specifically requests otherwise before completion of the order, Hat Refinery may photograph finished products we create and use those photographs for our portfolio, website, social media, advertising, samples, and promotional materials.
We will make reasonable efforts not to disclose private Customer information.
Customers purchasing confidential, unreleased, proprietary, memorial, or otherwise sensitive products may request in writing that their finished products not be photographed or publicly displayed.
Hat Refinery reserves the right to refuse or cancel an order when reasonably necessary, including orders involving unlawful content, suspected infringement, fraudulent activity, abusive conduct, safety concerns, technical limitations, unavailable materials, or requests that we are unable or unwilling to produce.
If Hat Refinery cancels an order before production for reasons unrelated to misconduct by the Customer, amounts paid for unperformed work will generally be refunded.
To the fullest extent permitted by applicable law, Hat Refinery and Holcomb Creative Enterprises LLC will not be liable for indirect, incidental, special, exemplary, or consequential damages arising from an order, product, service, shipping delay, loss of business, lost profits, or inability to use a product.
To the fullest extent permitted by applicable law, our total liability arising from a particular order will not exceed the amount actually paid to Hat Refinery for the product or service giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
Hat Refinery will not be responsible for delays or failure to perform caused by events reasonably outside our control, including severe weather, natural disasters, fire, flood, power outages, internet or communications failures, carrier interruptions, supply-chain disruptions, governmental actions, labor interruptions, equipment failures that could not reasonably have been anticipated, or similar events.
Hat Refinery attempts to keep product descriptions, pricing, photographs, availability, and other information accurate.
Occasionally, typographical errors, pricing errors, incorrect product information, or inventory discrepancies may occur.
We reserve the right to correct errors and, when legally permitted, cancel or modify an affected order. If an order is canceled because of our error, amounts paid for the canceled portion will be refunded.
Promotions, discount codes, special pricing, and coupons may be subject to additional terms and expiration dates.
Unless otherwise stated, discounts cannot be combined and have no cash value.
Discounts generally cannot be applied retroactively to completed purchases.
Applicable sales tax will be collected as required by law.
Customers claiming a sales-tax exemption or resale exemption are responsible for providing valid documentation before the applicable transaction when required.
These Terms & Conditions and transactions with Hat Refinery are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
Any legal rights or remedies provided to consumers under applicable federal, state, or local law remain available where they cannot legally be waived.
If any provision of these Terms & Conditions is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
Hat Refinery may update these Terms & Conditions periodically.
The Terms applicable to an order will generally be the version in effect when the Customer places the order, unless otherwise required by law or agreed to by the parties.
